FIND Terms & Conditions

Welcome to FIND! FIND is a platform brought to you by Hyatt to offer you the opportunity to enjoy unique experiences. These FIND Terms & Conditions (“Terms”) are an agreement between you and us that govern your booking of (and participation in) FIND Experiences (defined below) through hyatt.com/FIND (“Site”). Your use of the Site is also governed by the Hyatt Terms and Conditions, available at https://help.hyatt.com/en/hyatt-terms.html. These Terms include the terms and conditions for how FIND experiences integrate with the World of Hyatt program. (For complete terms applicable to your participation in the World of Hyatt program, please see worldofhyatt.com/terms.) Please also review Hyatt’s privacy policies, privacy.hyatt.com, which govern information you provide to us in connection with your use of the Site.
As used throughout the Site, the terms “Hyatt,” “our,” “we,” “us,” and other similar terms may refer to one or more of Hyatt Hotels Corporation, Hyatt Corporation, Hyatt International Corporation, Select Hotels Group, LLC, one or more of their direct or indirect subsidiaries or affiliates. These particular terms are used for convenience only and are not intended as a precise designation of any one particular entity. Such terms do not include any service provider that operates the Site on Hyatt’s behalf.
By accessing or using the Site, you agree to be bound by these Terms, as well as the Hyatt Terms and Conditions. If you do not agree, then you are not permitted to use the Site or book any Experience. If you are accessing and using the Site on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity.
An “Experience” means any experience, activity, or interaction – whether in-person or virtual –that may be offered by a Supplier via the Site. A “Supplier” is the person or entity that operates an Experience and offers that Experience via the Site. For certain Experiences, the Supplier may be a Hyatt hotel or resort (as expressly specified in the applicable Experience Listing). “Experience Listing” means the description of the Experience including, but not limited to, the price of the Experience and the date and time, as applicable, as well as any additional terms and conditions applicable to the Experience, such as age requirements for participants and the cancellation policy. Information about Experiences is provided by the Supplier and we do not verify the accuracy of that information.
A limited number of Experiences (or spaces in a particular Experience) may be available, and Experiences are all subject to availability. For all Experiences, all expenses and costs associated with participating in any Experience and not specifically stated in the Experience Listing as being included in the Experience fee (including, without limitation, costs and fees for travel, food or lodging) are the sole responsibility of the Member purchasing the Experience (and his or her guests, as applicable). Each Experience may be subject to minimum and maximum numbers of attendees as set out in the Experience Listing, and, if a minimum number is not met, the Experience may be rescheduled or, alternatively, cancelled with your payment returned.
BOOKING & PARTICIPATING IN AN EXPERIENCE
World of Hyatt Account Required.
If you want to use certain features of the Site (including booking any Experience), you will need to sign in to your World of Hyatt account from our Site. Use of the term “Member” in these Terms means any World of Hyatt Member who books an Experience or otherwise uses the Site.
You can only use the Site if you are eighteen (18) years or older, can enter into legally binding contracts, and are not barred from using the Site under applicable law. Some Experiences may require you to be a certain minimum age (e.g., at least 21 years of age) to book or participate in the Experience. Others may be available for purchase or attendance by individuals of all ages, while some aspects of the Experience may only be available to individuals who meet certain age requirements. (For example, a dinner that involves the service of alcohol may be open to attendees of all ages, but alcohol will not be served to individuals who have not reached the legal drinking age in that location.) Any such age requirements will be disclosed in the Experience Listing where applicable. You are responsible for the supervision of all minor participants you invite to participate in any Experience. The attendance of, or participation by, any unsupervised minors in an Experience is prohibited – unless otherwise expressly noted in the Experience Listing.
As an eligibility requirement for certain Experiences, we, a hotel or resort, or a Supplier may – either directly or through third-party service providers – verify your identity and/or require that you and any guest you invite to participate in the Experience submit to a background check. You agree to execute any additional documentation necessary to facilitate such background check. The Experience Listing will typically note where a background check is required.
Payments and Cancellations
You will be required to provide payment information upon booking any Experience and agree to pay all fees for any Experience booked through your World of Hyatt Membership. Fees will be charged at the time of booking. Charges will appear on your payment-method statement as “Hyatt FIND Experiences,” but please note that a Hyatt service provider is the merchant of record.
All Experiences are prepaid and non-refundable unless otherwise specified in the Experience Listing. Without limiting the foregoing, any Experience for which a Hyatt hotel or resort (or venue affiliated with any Hyatt hotel or resort) is the Supplier cannot be cancelled and is non-refundable, except where cancelled by the Supplier as otherwise provided for in these Terms. Other Experiences each have their own cancellation policy. Cancellation policies are determined by the Supplier and vary depending on the Experience. Please review each Experience Listing closely prior to purchasing. It is your responsibility to review Experience Listing and understand if, and under what circumstances, you may cancel an Experience and receive a full or partial refund. No refund or credit will be issued, and no World of Hyatt points will be returned, (a) if you do not cancel in accordance with the cancelation policy (to the extent an Experience is refundable at all) or (b) for any unused portion of an Experience.
Please note that particular details regarding any Experience are subject to change after booking and no Member will receive any refund or credit for any Experience provided on materially comparable terms to those described in the Experience Listing. If any aspect of an Experience is unavailable for any reason, the Supplier may, in its sole discretion, provide a substitute for that aspect or reschedule or cancel the Experience.
Supplier’s Right to Terminate Experiences at Will
Note that an Experience can be suspended and/or discontinued by the Supplier at any time – and with no refund to you – should you or any of your guests engage in any conduct that (i) is abusive, harassing, threatening, derogatory, disrespectful, lewd, hateful, obscene, offensive, or otherwise inappropriate towards Supplier, any other party participating in the Experience, or any third party or (ii) disturbs other Experience guests or attendees at the Experience location/venue or otherwise disrupts or impairs the normal operation of that location/venue (all as determined by Supplier in its sole discretion). This right to suspend or discontinue an Experience is without limitation to any additional rights reserved by the Supplier pursuant to the terms set out in the Experience Listing or any other Experience-related communication you may have with the Supplier.
Code of Conduct
Without limiting any additional restrictions on your use of the Site as set forth in the Hyatt Terms and Conditions, you agree that you will not (and will not attempt to or assist any third party to):
• Make payments (or accept refunds) for an Experience outside of the Site;
• Recruit or otherwise solicit any Supplier or other user to join third-party services or websites that are competitive to the Site, without our prior written approval;
• Book any Experience under a false name or using another person’s World of Hyatt account or otherwise engage in any other fraudulent conduct; or
• Resell any Experience (or any component thereof) or transfer it for value to a third party without our prior written consent and that of the applicable Supplier.
OUR ROLE AS A SERVICE PROVIDER
Hyatt is a service provider making available the FIND platform for the booking of Experiences by World of Hyatt Members. The Supplier is responsible for honoring any purchased Experience. Hyatt is not responsible for honoring or operating any Experience unless expressly identified as the Supplier in the applicable Experience Listing. The Supplier may require any Member booking an Experience or any other party participating in that Experience to enter into an agreement with the Supplier, which may include a waiver and liability and/or publicity release. You acknowledge that, if you fail to do so, you may not be able to participate in the Experience (but will remain subject to the cancellation/refund policy for that Experience) or may have your participation limited. Some Experiences include the ability to interact with a Supplier. We cannot control your interactions with Suppliers and we expressly disclaim any liability arising from such interactions. Unless expressly disclosed, we do not plan, host, operate, or provide the Experiences or endorse any Supplier or Experience.
WE ASSUME NO RESPONSIBILITY FOR AND EXPRESSLY DISCLAIM ANY LIABILITY ARISING FROM YOUR PARTICIPATION OR INABILITY TO PARTICIPATE IN AN EXPERIENCE OR THE ACTS OR OMISSIONS OF ANY SUPPLIER. OUR RESPONSIBILITIES ARE LIMITED SOLELY TO FACILITATING THE AVAILABILITY OF THE SITE, ADMINISTERING THE WORLD OF HYATT PROGRAM AS IT RELATES TO FIND EXPERIENCES, AND FACILITATING PAYMENTS TO THE SUPPLIER.
WORLD OF HYATT POINT EARNING AND REDEMPTION; AUCTIONS
Eligible World of Hyatt Members who participate in FIND agree to these Terms, which are in addition to the World of Hyatt Terms & Conditions (available at www.worldofhyatt.com/terms) (“World of Hyatt Terms”). In the event of an express conflict between these Terms and the World of Hyatt Terms regarding the integration of FIND Experiences with the World of Hyatt Program, these Terms will control. Capitalized terms that are not defined in these Terms have the meaning ascribed to them in the World of Hyatt Terms.
Earning World of Hyatt Points
Members may earn ten (10) World of Hyatt Base Points for each whole U.S. dollar or U.S. dollar equivalent spent by the Member on the Eligible FIND Revenue (defined below) portion of an Experience purchased on this Site. Members who have obtained an elite tier in World of Hyatt and are entitled to Bonus Points on qualifying purchases will earn those bonuses on the Eligible FIND Revenue for an Experience purchased on the Site. Such bonuses will be awarded as Bonus Points. Experiences booked through any means other than this Site will not qualify for any World of Hyatt benefits. “Eligible FIND Revenue” is the final purchase price of an Experience purchased on this Site excluding taxes, gratuities, or service charges, which may be included in the purchase price stated on the Site.
Only the Member purchasing the Experience may earn points for the purchase. Members may not earn Partner Loyalty Points, MGM Rewards Tier Credits, or other substitutes in lieu of points unless expressly authorized in writing by Hyatt. No points will be earned on Experiences obtained by redeeming points. A Member who was not properly credited for points earned in connection with an Experience purchase may request an adjustment within one (1) year of purchasing the Experience by contacting World of Hyatt customer service.
Redeeming World of Hyatt Points
Some Experiences may be booked with either a monetary payment or by redeeming World of Hyatt points, while others may offer only one of those methods. Experiences available for point redemption will indicate the number of points required (or may be offered as part of an auction, as described in more detail below). Members cannot combine points and a monetary payment to purchase a single Experience. Please note that the number of points required may be measured per person or per Experience and that may vary from Experience to Experience. Points redeemed on the Site will be deducted from the Member’s World of Hyatt account within approximately three (3) days of booking the Experience.
Other World of Hyatt Benefits for Certain Experiences.
Unless expressly permitted, no other award, upgrade, credit, or other World of Hyatt benefit besides points may be redeemed or used in connection with FIND or an Experience. Notwithstanding the foregoing, for any Experience where a Hyatt hotel or resort is the Supplier and the Experience includes overnight accommodations at such Hyatt hotel or resort, the booking Member will earn a Tier-Qualifying Night for each eligible night stayed as part of the Experience, in accordance with the World of Hyatt Terms, and will also receive In-Hotel Benefits during such stay.
Some Experiences may be offered via auction conducted through the Site. The only accepted method of payment for auctions is World of Hyatt points.
During an auction, Members may submit a bid indicating the number of World of Hyatt points that the Member is willing to redeem for the Experience. The auction listing will indicate the minimum starting bid (if any) and the point increment in which bids must be increased. The Member must have enough points in his/her World of Hyatt account to place a bid.
Once a Member places a bid, it cannot be retracted, modified, or canceled. By bidding, you agree that you are entering into a legally binding contract to pay for that auction Experience with World of Hyatt points if you are the winner. An auction Experience may be subject to additional terms and conditions as specified in the Experience Listing or other auction-related materials. Each bidder agrees to fully comply with such additional terms and conditions, as well as these Terms and the World of Hyatt Terms. Hyatt’s database clock for the servers operating the Site will be the official timekeeper for each auction.
The Member with the highest bid at the close of the auction period will be the winner. The winner will be contacted with instructions on how to redeem the World of Hyatt points bid and claim the auctioned Experience. The winner must then complete the redemption process in accordance with and by the deadline set forth in Hyatt’s instructions. If the winner fails to timely complete the redemption process, the auctioned Experience will be forfeited and may, in Hyatt’s sole discretion, be offered to the second-place bidder. In such case, the initial winning bidder may also be prohibited from participating in future auctions, as determined by Hyatt in its sole discretion. Experiences won at auction cannot be cancelled.
These Terms, the Hyatt Terms and Conditions, the World of Hyatt Terms (and, as applicable, any additional terms set out in an Experience Listing for which Hyatt is the Supplier) constitute the entire and exclusive understanding and agreement between you and us regarding the Site and Experiences. The Terms supersede and replace any and all prior oral or written understandings or agreements between you and us regarding the Site and Experiences.
Limitation of Liability, Disclaimers, Indemnity.
In addition to the disclaimers and limitations on liability set out in the Hyatt Terms and Conditions, which you understand and agree apply to the Site and any Experience, you further acknowledge and agree as follows:
· AS BETWEEN YOU AND US, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE AND PURCHASE OF OR PARTICIPATION IN ANY EXPERIENCE. NONE OF (i) HYATT, (ii) ANY HYATT PARENT, SUBSIDIARY, DIVISION, AFFILIATE, AGENT, REPRESENTATIVE, HOTEL OWNER, LICENSOR OR LICENSEE, (iii) ANY SERVICE PROVIDER PARTICIPATING IN THE OPERATION OF THE SITE, OR (iv) ANY OF THEIR RESPECTIVE EMPLOYEES, OFFICERS, OR DIRECTORS (ALL COLLECTIVELY, THE “HYATT PARTIES”) – INCLUDING, WITHOUT LIMITATION, WHERE ANY HYATT PARTY IS ACTING AS A SUPPLIER UNDER THESE TERMS – ARE RESPONSIBLE FOR, AND ALL HEREBY EXPRESSLY DISCLAIM ANY LIABILITY FOR, ANY PERSONAL INJURY, DAMAGE OR HARM RESULTING FROM YOUR USE OF THE SITE OR PURCHASE OF OR PARTICIPATION IN ANY EXPERIENCE (OR INABILITY TO DO SO).
· IN NO EVENT WILL THE TOTAL LIABILITY OF THE HYATT PARTIES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR PARTICIPATION IN OR INABILITY TO PARTICIPATE IN ANY EXPERIENCE EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID US FOR EXPERIENCES IN THE TWELVE (12) MONTH PERIOD PRECEDING THE CLAIM OR ACTION OR TEN U.S. DOLLARS ($10 US).
· You will defend, indemnify and hold the Hyatt Parties harmless from and against any claims, disputes, demands, liabilities, damages, losses, costs and expenses (including, without limitation, attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Site; (b) your purchase or participation in any Experience (or inability to do so); or (c) your breach of these Terms or any other terms applicable to your use of the Site or purchase of or participation in any Experience.
Changes to these Terms or the Site; Discontinuation of FIND.
We may change these Terms at any time. If we do so, we will let you know by posting the revised Terms on the Site and/or through other communications. Your continued use of the Site following the effective date of any changes means that you accept and agree to the revised Terms. In addition, we may change or discontinue all or any part of the Site or the FIND program, at any time and without notice, at our discretion (provided that such discontinuance will not impact previously booked Experiences unless otherwise expressly communicated by Hyatt or the applicable Supplier).
